Participant Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement
Every player signs this once for each event, when they register or from the waiver link their captain sends them. The signed copy names that event and its venue.
OFFSIDE INDOOR SPORTS, LLC
This Event is restricted to participants who are eighteen (18) years of age or older as of the date of the Event. This Agreement contains no minor-participation or parental consent provisions and none are applicable.
1. Acknowledgment of Risk
I, the undersigned participant ("Participant"), acknowledge that participation in soccer activities, including the Offside event (the "Event") organized by Offside Indoor Sports, LLC ("Offside"), involves inherent and significant risks of physical injury, including but not limited to sprains, strains, fractures, concussions, cardiac events, and in rare cases, permanent disability or death. These risks may result from Participant's own actions, the actions of other participants, the condition of the playing surface or facility, equipment, or other factors, and may exist whether or not caused by the negligence of Offside, the facility, or any other party. I voluntarily choose to participate with full knowledge of these risks.
2. Assumption of Risk
I voluntarily assume full responsibility for any risk of loss, property damage, or personal injury, including death, that may be sustained by me, and for any loss or damage to property owned by me, as a result of participating in the Event.
3. Release and Waiver of Liability
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I, ON BEHALF OF MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE OFFSIDE INDOOR SPORTS, LLC, ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS, AS WELL AS THE FACILITY AT WHICH THE EVENT IS HELD AND ITS OWNERS AND EMPLOYEES (COLLECTIVELY, THE "RELEASED PARTIES"), FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT MAY BE SUSTAINED BY ME WHILE PARTICIPATING IN THE EVENT, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
Nothing in this Agreement releases any Released Party from liability for gross negligence, willful misconduct, or intentional acts, to the extent such release is prohibited under Texas law.
4. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable attorneys' fees, that any Released Party may incur due to my participation in the Event, to the extent caused by my own acts or omissions.
5. Medical Treatment Authorization
I authorize Offside and Event staff to secure emergency medical treatment for me in the event of injury or illness during the Event, and I agree to be financially responsible for any costs associated with such treatment. I understand that Offside does not carry health or accident insurance covering Participant injuries, and that I am solely responsible for my own medical or health insurance coverage.
6. Rules and Conduct
I agree to follow all facility rules and Event rules communicated by Offside staff. I understand that fighting, threats, abusive conduct, or deliberate dangerous play may result in my immediate removal from the Event without refund.
7. Physical Condition
I represent that I am physically fit and have no medical condition that would prevent my safe participation in soccer activities, or that I have voluntarily disclosed any relevant medical information to Offside and assume all risk of participating despite such condition.
8. Photo/Video Release
Photo and video consent is addressed as a separate, optional question at registration and is not a condition of participation in the Event. This Agreement's validity does not depend on Participant's photo/video consent choice.
9. Governing Law; Severability
This Agreement shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
10. Acknowledgment
I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SUE THE RELEASED PARTIES. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY, AND INTEND MY ELECTRONIC SIGNATURE BELOW TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
